The fixed increase of 25% in residential rent will be effective as of 11 June

The legal regulation that limits residential rent increases to 25% came into effect yesterday. The 25% limit will be applied from 11 June 2022 to 1 July 2023. Landlords will not be able to forcibly evict tenants, eviction lawsuits will be denied. With the arrangement, the tenants will breathe easily for 1 year.

ONE YEAR THE RATE WILL BE FIXED

This rule will also apply to lease agreements for more than one year. Contracts made in a way that exceeds the rates will be deemed invalid in terms of excess amount. This provision will also be applied in terms of decisions to be made by the judge. In case the house is sold, the tenant’s old lease agreement will continue. The landlord can raise 25%, but cannot ask for more. With the new application, citizens will not follow the CPI average, the increase rate will be fixed for 12 months. Thus, the rent from ₺2 thousand will increase to ₺2 thousand 500, and the rent from ₺3 thousand will increase to ₺3 thousand 750. Since the legislation cannot be applied retrospectively, it will not cover previously renewed contracts.

REJECTION TO EVACUATION CASES

The regulation regarding rent increases is temporary and will only be applied to residences. Minister of Justice Bekir Bozdag stated that if an eviction lawsuit is filed, the court will reject it, “I do not think that he will issue an eviction decision based on this reason in the face of the legal regulation. The law also binds the court. The landlord cannot force a tenant out.”
