The regulation prohibiting the sale of second-hand vehicles at a price higher than their new price has been extended for another 6 months.
Prepared by the Ministry of Commerce, the “Regulation on Amendments to the Regulation on the Trade of Second-Hand Motor Vehicles” came into force after being published in the Official Gazette.
Accordingly, the regulations regarding “marketing and sales restriction” and “advertising restriction” have been extended again for 6 months, starting from January 1, 2024.
According to the written statement made by the Ministry on the subject, studies are being carried out to take the necessary measures against speculative price increases and stockpiling activities that have occurred in the automotive sector in recent months.
In this context, in order to prevent exorbitant price increases in the automotive market, stockpiling activities and unfair commercial gains, and to prevent consumer grievances, amendments were made to the said regulation and regulations regarding “marketing and sales restrictions” and “advertising restrictions” were implemented.
It was decided to extend the regulations again after it was determined that the supply and demand in the automotive market were balanced and in favor of consumers.
Notary offices prevent illegal sales
On the other hand, the practice of blocking sales within the scope of commercial activities that violate the “6 months and 6 thousand kilometers marketing and sales restriction” by notary public offices will continue.
Accordingly, in addition to those who engage in second-hand motor vehicle trade with a second-hand motor vehicle trade authorization certificate, sales of all natural or legal persons who sell 3 or more second-hand motor vehicles without authorization within a calendar year, in violation of the “6 months and 6 thousand kilometers regulation”, will be blocked by notary publics.
In addition, second-hand motor vehicles will not be “marketed by advertisement” at a price above the current sales price recommended by the manufacturer or distributor until July 1, 2024. With the regulation, the Ministry has the authority to extend this date for up to 6 months.
