Installation of charging stations requires permit from assembly now on

Yahya Sağır, President of the Facility Managers Confederation, said, “Residents who want to set up a car charging station need to discuss this with the management boards of their sites and obtain a decision either at the ordinary or extraordinary general assembly meetings.”

Istanbul The widespread use of electric vehicles both globally and in Turkey is increasing the need for charging stations.

While both the private sector and public institutions continue their efforts in this regard, alternative solutions are particularly prominent in metropolises like Istanbul. One of these solutions is the installation of charging points in sites, which host large populations and collective living spaces.

“The installation cost of the charging station should be discussed at the general assembly” Yahya Sağır, President of the Facility Managers Confederation, explained to AA correspondent the questions about setting up car charging stations in sites.

Sağır stated that residents of residential complexes who own electric vehicles may face the management and other apartment owners regarding the charging of their vehicles.

Sağır noted that if the tasks to be carried out in sites and the fixtures expenses fall under the category of luxury investments according to the Condominium Law, the approval of four-fifths majority is required.

Sağır also mentioned that car charging stations fall under this category.

Residents who want to establish a car charging station need to discuss this with the management boards of their sites and obtain a decision either at the ordinary or extraordinary general assembly meetings,” said Sağır, providing the following information:

“That decision should be as follows; Consider a site with 100 independent sections, where approximately 20 of the owners have electric vehicles and request the installation of a charging station for their vehicles. What is the expense for this? The installation cost of the car charging station should be discussed at the general assembly, and the decision should also be made with a four-fifths majority at the general assembly. If others will benefit from the expense to be made in the general assembly, including the other apartment owners, guests of the apartment owners, the expenses incurred by everyone according to the decision made with four-fifths majority can be shared. If it is stated that only the 20 independent section apartment owners will benefit from this, again, a four-fifths majority is required.”

Sağır emphasized the need to record the decision taken, indicating that the problem and confusion in this regard stem from the fact that the situation regarding car charging stations is not included in the parking regulations and Condominium Law.

“Those who want to establish a charging station should work with EPDK-approved companies” Sağır drew attention to the need for the managements who want to set up car charging stations in sites to work with EPDK-approved companies.

Sağır also said that the adequacy of the site or building’s electrical power to install a charging station is crucial at this point, stating that it is wrong for apartment owners to use their own electricity meters for this purpose.

Sağır stated, “These can lead to very serious problems because the electrical power of the building is unknown. For example, they can face fire problems. In such a situation, what does the management do? It has the authority to restore it, to remove it. Because no permission has been obtained in any way. Therefore, it is absolutely necessary to obtain approval with four-fifths majority from the general assembly.”

Sağır also added that as the Facility Manufacturers Confederation, they have submitted petitions to the Turkish Grand National Assembly, the Ministry of Environment, Urbanization, and Climate Change, and the Ministry of Trade to prevent these problems from growing.
